Estate Basics

Estates. Upon the death of an individual, a PROBATE ESTATE or ESTATE must be opened by filing appropriate documents with the court. Usually you open an estate in the state in which the decedent (individual who died) resided. Before you can access and close the decedent's accounts and manage their affairs, you must first open the estate since most companies will require the LETTERS OF ADMINISTRATION (and the Death Certificate as well as variously other information) of the estate. The Letters of Adminstration are what the court issues as documentary evidence of the estate and of the appointment of the executors or personal representatives of the estate.
